ARTICLE 16 C: WHO ARE CONSIDERED AS RECOGNIZED MARKETS

     

    For the purposes of the provisions of article 16-A of this Code (CFF: Art. 16A), are considered as recognized markets:

  • The Mexican Stock Exchange and the Mexican Derivatives Exchange.
  •  

  • The stock exchanges and the equivalent systems of stock quote, contracts or goods, that have at least five years of operation and have been authorized to operate with such character in accordance with the laws of the country in which they are located, where the prices determined are public knowledge and cannot be manipulated by the contracting parties of the derivative financial transaction.
  •  

  • In the case of price indexes, these must be published by the National Institute of Statistic and Geography (Instituto Nacional de Estadística y Geografía), by the equivalent monetary authority or by the competent institution to calculate them, so that the underlying is considered as determined in a recognized market. In the case of a derivative financial operations referring to interest rates, the exchange rate of currency or another indicator, it will be understood that the underlying instruments are negotiated or determined in a recognized market when the information regarding said indicators are public knowledge and published in a printed medium, whose source is an institution recognized in the market in question.
