    • ARTICLE 107: QUALIFIED CONTRABAND

     

    The offense of contraband will be qualified when it is committed:

  • With physical or moral violence against people.

    •  

  • At night or by an unauthorized place for entering or leaving the country of merchandise.

    •  

  • Hold the author as a public official or employee.

    •  

  • Using fake documents.

    •  

  • For three or more people.

    •  

    The qualifications referred to in sections III, IV and V of this article shall also apply to the offense provided for in article 105 of this Code. (CFF: Art. 105)

    When the offenses referred to in this article are qualified, the corresponding sanction shall be increased from three months to three years in prison. If the qualification constitutes another offense, the rules of accumulation will apply.
