    • ARTICLE 111 BIS: PENALTIES APPLICABLE FOR FAILING TO COMPLY WITH THE VOLUMETRIC CONTROLS OF ANY TYPE OF HYDROCARBON OR OIL

    A sanction of 3 to 8 years of imprisonment will be imposed on those who:

  • Failure to maintain volumetric controls, or counting these, are carried out in contravention of the provisions of article 28 (CFF: Art. 28), section I, section B of this Code.

  • Lack, alter, disable, or destroy the equipment and software designed to carry out the volumetric controls referred to in article 28 (CFF: Art. 28), section I, section B of this Code.

  • Make, allow, or deliver to the authority, false records that mislead, incomplete, or inaccurate in the volumetric controls referred to in article 28 (CFF: Art. 28), section I, section B of this Code.

    In order to proceed criminally for this crime, it will be necessary for the Secretary of Finance and Public Credit (Secretaría de Hacienda y Crédito Público) to file a complaint, regardless of the state in which the administrative procedure is, that in their case may be initiated.
