ARTICLE  130:  ADMISSION  OF  EVIDENCE

In  the  appeal  for  revocation,  all  kinds  of  evidence  will  be  admitted,  except  for  the  testimony  and  confession  of  the  authorities  through  interrogation.  The  request  for  reports  to  the  tax  authorities  regarding  the  facts  contained  in  their  files  or  documents  added  to  them  will  not  be  considered  included  in  this  prohibition.

New  evidence  may  be  submitted  provided  that  the  resolution  of  the  appeal  has  not  been  issued.

When  the  appellant  announces  that  it  will  exhibit  the  evidence  in  the  terms  of  the  provisions  of  the  last  paragraph  of  article  123  of  this  Code  --622-Art.  123--,  it  will  have  a  period  of  fifteen  days  to  submit  them,  contact  from  the  day  following  the  announcement.

The  authority  that  knows  of  the  appeal,  for  a  better  knowledge  of  the  controversial  facts,  may  agree  to  display  any  document  that  is  related  to  them,  as  well  as  order  the  practice  of  any  procedures.

They  will  make  full  proof  of  the  express  confession  of  the  appellant,  legal  presumptions  that  do  not  admit  evidence  to  the  contrary,  as  well  as  the  facts  legally  affirmed  by  the  authority  in  public  documents;  including  digital  ones;  but,  if  the  public  documents  cited  contain  statements  of  truth  or  statements  of  facts  of  individuals,  the  documents  only  fully  prove  that,  before  the  authority  that  issued  them,  such  declarations  or  statements  were  made,  but  they  do  not  prove  the  truth  of  the  declarations  or  statements.

In  the  case  of  digital  documents  with  an  electronic  signature  other  than  an  advanced  electronic  signature  or  digital  stamp  --611-Art.  17E--,  for  its  evaluation,  the  provisions  of  article  210-A  of  the  Federal  Code  of  Civil  Procedures  (Código  Federal  de  Procedimientos  Civiles)  will  be  followed.

The  other  evidence  will  be  left  to  the  prudent  assessment  of  the  authority.

If  by  the  link  of  the  evidence  rendered  and  the  assumptions  formed,  the  authorities  acquire  a  different  conviction  about  the  facts  of  the  appeal,  they  may  assess  the  evidence  without  subject  to  the  provisions  of  this  article,  and  in  that  case  they  must  reasonably  base  this  part  of  their  resolution.

For  the  processing,  relief,  and  valuation  of  the  evidence  offered  and  admitted,  the  legal  provisions  that  apply  to  the  federal  administrative  contentious  trial  will  be  applicable,  through  which  resolutions  that  put  an  end  to  the  appeal  for  revocation  can  be  challenged,  as  long  as  it  is  not  oppose  the  provisions  of  this  Chapter.
