ARTICLE  159:  PROCEDURES  ON  ASSETS  ALREADY  SEIZED

 

When  the  assets  indicated  for  the  levying  are  already  seized  by  other  non-tax  authorities  or  subject  to  foreclosure,  the  procedure  will  nonetheless  be  carried  out.  Said  assets  will  be  delivered  to  the  depositary  designated  by  the  executing  office  or  by  the  executing  agency  and  the  corresponding  authority  will  be  notified  so  that  it  or  the  interested  parties  can  demonstrate  their  priority  right  in  the  collection.

If  the  assets  indicated  for  the  execution  have  already  been  seized  by  local  tax  authorities,  the  procedure  will  be  carried  out,  the  assets  being  delivered  to  the  depositary  designated  by  the  federal  authority  and  the  local  authority  will  be  notified.  In  case  of  disagreement,  the  resulting  dispute  will  be  resolved  by  the  judicial  courts  of  the  Federation.  While  the  respective  procedure  is  resolved,  the  product  will  not  be  applied,  unless  the  tax  interest  is  guaranteed  to  the  satisfaction  of  the  Secretary  of  Finance  and  Public  Credit  (Secretaría  de  Hacienda  y  Crédito  Público)
