ARTICLE  153:  CUSTODY  OF  GARNISHMENT  ASSETS

The  garnishment  or  negotiations  may  be  left  under  the  custody  of  the  depositories  that  are  necessary.  The  heads  of  the  executing  offices,  under  their  responsibility,  will  freely  appoint  and  remove  the  depositaries,  who  will  serve  in  accordance  with  the  legal  provisions.  When  the  depositary  is  removed,  the  depositor  must  make  available  to  the  executing  authority  the  assets  that  were  the  object  of  the  depository,  and  the  latter  may  carry  out  the  subtraction  of  the  assets  to  deposit  them  in  warehouses  under  their  safekeeping  or  deliver  them  to  the  new  depositary.

In  real  estate  or  negotiation  seizures,  depositaries  will  have  the  character  of  administrators  or  receivers,  as  the  case  may  be,  with  the  faculties  and  obligations  indicated  in  articles  165,  166  and  167  of  this  Code.  --630-Art.  165--  --630-Art.  166--  --630-Art.  167--

The  responsibility  of  the  depositaries  will  cease  with  the  delivery  of  the  seized  assets  to  the  satisfaction  of  the  tax  authorities.

The  executor  may  place  official  stamps  or  marks  with  which  the  seized  assets  are  identified,  which  shall  be  recorded  in  the  minutes  referred  to  in  the  first  paragraph  of  article  152  of  this  Code.  --629-Art.  152--

The  depositary  shall  be  designated  by  the  executor  when  the  head  of  the  exacting  office  has  not  done  so,  and  the  appointment  may  fall  upon  the  executed.
