ARTICLE 181: PROCEDURE TO SEND THE BIDS

The bids must be sent in a digital document with an advanced electronic signature, to the electronic address indicated in the announcement for the auction. The Service Tax Administration (Servicio de Administración Tributaria) will send messages confirming the receipt of the bids. Said messages will have the characteristics that the aforementioned body has issues through general rules. To intervene in an auction, it will be necessary for the bidder, before sending their bid, to make an electronic transfer of funds equivalent to at least ten percent of the value set to the assets in the announcement. This transfer must be made in accordance with the general rules issued for this purpose by the Service Tax Administration (Servicio de Administración Tributaria) and its amount will be considered as a deposit for the purposes of the following paragraph and the Arts. 184, 185 and 186 of this Code. The amount of the deposits that are constituted in accordance with what is established in this article, will serve as a guarantee for the fulfillment of the obligations assumed by the bidders for the awards made to them of the auctioned goods. After the auction is finished, the electronically transferred funds will be returned to the bidders, except those corresponding to the admitted one, whose value will continue as a guarantee of compliance with their obligation and, as the case may be, as part of the sale price.

The Service Tax Administration (Servicio de Administración Tributaria), through general rules, may establish administrative facilities so that in place of the advanced electronic signature, other means of electronic identification are used.
