ARTICLE  24:  TRANSITORY  OF  JUNE  17,  2016

First.-  This  Decree  will  enter  into  force  on  the  day  following  its  publication  in  the  Official  Journal  of  the  Federation  (Diario  Oficial  de  la  Federación)  except  as  provided  in  the  following  article.

Second.-The  amendments  to  the  National  Code  of  Criminal  Procedures  (Código  Nacional  de  Procedimientos  Penales),  to  the  Federal  Penal  Code  (Código  Penal  Federal),  to  the  General  Law  to  Prevent  and  Punish  Crimes of Kidnapping  (Ley  General  para  Prevenir  y  Sancionar  los  Delitos  en  Materia  de  Secuestro),  Regulatory  of  Section  XXI  of  Article  73  of  the  Political  Constitution  of  the  United  Mexican  States,  Articles  2,  13,  44  and  49  of  the  Federal  Law  for  the  Protection  of  Persons  Involved  in  Criminal  Procedure  (Ley  Federal  para  la  Protección  a  Personas  que  Intervienen  en  el  Procedimiento  Penal)  and  Articles  21  in  section  X,  50  Bis  and  158  of  the  Organic  Law  of  the  Judicial  Power  of  the  Federation  (Ley  Orgánica  del  Poder  Judicial  de  la  Federación),  should  be  effective  in  terms  of  the  provisions  of  the  Second  Transitory  Article  of  the  Decree  issuing  National  Code  of  Criminal  Procedures  (Código  Nacional  de  Procedimientos  Penales)  published  in  the  Official  Journal  of  the  Federation  (Diario  Oficial  de  la  Federación)  on  March  5,  2014.

The  procedures  that  are  in  process,  related  to  the  modifications  to  the  legal  precepts  contemplated  in  this  Decree,  will  be  resolved  in  accordance  with  the  provisions  that  gave  cause  to  them.

Third.-  Within  180  calendar  days  of  the  entry  into  force  of  this  Decree,  the  Federation  and  the  federative  entities  within  the  scope  of  their  respective  competences  must  have  a  Supervisory  Authority  for  Precautionary  Measures  and  Conditional  Suspension  of  the  Process.

Likewise,  within  30  days  after  the  date  of  creation  of  the  precautionary  measures  authorities  and  the  conditional  suspension  of  the  Federation  process  and  the  federal  entities,  that  the  agreements  and  guidelines  that  regulate  their  organization  and  operation  must  be  issued.

Fourth.-  The  provisions  of  this  Decree  relating  to  criminal  enforcement  shall  enter  into  force  once  the  legislation  in  force  in  the  matter  provided  for  in  article  73,  section  XXI,  subsection  c)  of  the  Political  Constitution  of  the  United  States  of  Mexico  enters  into  force.

Fifth.-  In  the  case  of  those  measures  deprived  of  personal  liberty  or  of  preventive  detention  that  have  been  decreed  by  order  of  the  judicial  authority  during  the  proceedings  initiated  based  on  the  criminal  procedural  legislation  in  force  prior  to  the  entry  into  force  of  the  accusatory  criminal  justice  system  adversarial,  the  attribute  or  the  accused  may  request  the  review  of  said  measures  to  the  competent  court,  so  that  the  judge  of  the  case,  in  the  terms  of  articles  153  to  171  of  the  National  Code  of  Criminal  Procedures  (Código  Nacional  de  Procedimientos  Penales),  having  seen  the  parties,  so  that  the  Public  Ministry  investigates  and  accredits  what  is  conducive,  and  held  the  corresponding  hearing,  the  court,  taking  into  consideration  the  risk  assessment,  resolves  on  the  imposition,  revision,  substitution,  modification,  or  termination,  in  terms  of  preventive  detention  of  article  19  of  the  Political  Constitution  of  l  The  United  Mexican  States,  as  well  as  National  Code  of  Criminal  Procedures  (Código  Nacional  de  Procedimientos  Penales).  In  the  event  of  replacing  the  precautionary  measure,  the  surveillance  thereof  shall  be  applied  in  accordance  with  articles  176  to  182  of  the  aforementioned  Code.

Sixth.-  The  Attorney  General  of  Mexico  (  Procuraduría  General  de  la  República)  will  propose  to  the  National  Public  Security  Council  the  achievement  of  the  agreements  it  deems  necessary  between  the  authorities  of  the  federative  entities  and  the  federation  within  the  framework  of  the  Federal  Law  for  the  Protection  of  Persons  Involved  in  Criminal  Procedure  (Ley  Federal  para  la  Protección  a  Personas  que  Intervienen  en  el  Procedimiento  Penal).
