ARTICLE  59:  ELEMENTS  THAT  DETERMINE  THE  EXISTENCE  OF  DAMAGE

 

The  Ministry  --439-Art.  1--  must  verify,  through  the  corresponding  investigation  procedure,  that  the  damage  referred  to  in  article  39  of  the  Law  --257-Art.  39--  derives  from  the  minimum  analysis  of  all  the  elements  referred  to  in  articles  41  and  42  --257-Art.  41--  --257-Art.  42--  of  the  same  order,  as  appropriate.  In  no  case,  the  investigating  authority  will  determine  the  existence  of  damage  according  to  what  is  established  by  the  civil  legislation.
