ARTICLE 63: PROCEDURE TO DETERMINE THE EXISTENCE OF DAMAGE

For the determination of the existence of damage, the Ministry (RLCE: Art. 1) must evaluate the impact of the investigated imports on the national production.

Applicants must submit to the Ministry, through the respective investigation forms, the total national production information, provided that the required figures are reasonably available. In any case, they must always submit in the request a reliable estimate, and the corresponding methodology, of the figures relative to the total national production considered.

The Ministry shall ensure that the corresponding damage determination is representative of the situation of the national production.
