ARTICLE 74: EVALUATION OF THE FACTORS THAT INFLUENCE THE AFFECTED INDUSTRY

The Ministry (RLCE: Art. 1) will evaluate the factors indicated in article 48 of the Law (LCE: Art. 48), within the context of the economic cycle and the specific competition conditions of the national production in question. To this end, the applicants will provide information on the relevant and characteristic factors and indicators of the industry, normally considering three years prior to the submission of the request, including the period under investigation, unless the company in question has been constituted in a shorter span. Likewise, the request of national producers or the organizations that represent them will provide economic studies, monographs, technical literature and national and international statistics on the behavior of the market in question, or any other documentation that allows identifying the economic cycles and the specific competition conditions in the affected industry.
