ARTICLE 129: REQUEST FOR AN INVESTIGATION TO IMPOSE A PROVISIONAL EMERGENCY SAFEGUARD

The request of the interested party to initiate an administrative investigation to impose the safeguard measures in critical circumstances must be submitted in writing, manifesting the need to apply the safeguards regime, accompanied by the pertinent information and evidence reasonably within reach.

The request must contain the data referred to in article 118 of this Regulation (RLCE: Art. 118), except for the adjustment program provided for in section XII of said article and, in addition, an explanation of the hardly repairable damage that would occur when delaying the application of safeguard measures.

The adjustment program must be submitted within a period not exceeding 30 days after the publication of the resolution establishing provisional safeguard measures.
