ARTICLE 182: AUTHORIZATION FOR THE ESTABLISHMENTS OF THE FISCAL DEPOSIT FOR ASSEMBLY AND MANUFACTURING PROCESS OF VEHICLES

     

    For the purposes of the provisions of article 121, section IV of the Law (LA: Art. 121), the Customs Authority may authorize the establishment of fiscal deposits to submit merchandise to the assembly and manufacturing process of vehicles, to companies of the terminal automotive industry, provided that the interested parties are up to date in compliance with their tax obligations and meet the following requirements:

  • Are owners or holders of the facilities for which authorization is sought;
  •  

  • They are registered as a producer of new light motor vehicles or in the Sector Promotion Program of the Automotive and Auto Parts Industry;
  •  

  • Present sketches of the property to be authorized;
  •  

  • Prove the payment that corresponds according to the Federal Rights Law (Ley Federal de Derechos), and
  •  

  • The others established by the Service Tax Administration (Servicio de Administración Tributaria) (RLA: Art. 1) through Rules. (RGCE 2022: Regla 4.5.30)
  •  

    The validity of the authorization will be up to ten years and may be extended at the request of the interested party, up to an equal period, provided that the request for extension is submitted sixty days before the expiration of the authorization and the fulfillment of the requirements indicated for the granting of the authorization at the time of said request, and is up to date in the fulfillment of the obligations inherent to the authorization.

    In no case, the term of authorization and extension will be greater than that for which the authorized people have the legal possession of the facilities for which authorization is sought.

    The Service Tax Administration (Servicio de Administración Tributaria) will cancel the authorization according to the procedure provided for in article 144-A of the Law (LA: Art. 144A), to those who fail to comply with the requirements established for the granting of the authorization and the obligations inherent in the authorization.
