ARTICLE 241:
The concessionaires of rights of emission and reception of signals and frequency bands associated with foreign satellite systems that cover and can provide services in the National Territory, that provide the service of provision of satellite capacity, will pay for the use, enjoyment or exploitation of the radio spectrum in the section included within the National Territory, for each day of use, according to the following fees:
When the concessionaire uses frequency bands of the radio spectrum for fractional days, it will pay the proportional part of the fees established in sections I and II above, as appropriate.
The payment of the right referred to in this article, must be paid in accordance with the following:
In July, the amount corresponding to the megahertz used must be paid no later than the 17th, during the period from January to June of the fiscal year in question; and no later than the 17th day of the following January, the amount corresponding to the megahertz used in the period from July to December of the immediately preceding year.
For the calculation of the payment of right referred to in this article, will be subtracted from the total number of megahertz used, the number of megahertz of space segment that the concessionaire is obligated to contribute, free of charge, to the Secretary of Communications and Transportation (Secretaría de Comunicaciones y Transportes) in accordance with its Title of Concession.
The annual amount of the right to pay cannot be greater than the result obtained from subtracting from the amount obtained in accordance with sections I and II above, the net annual amount that has been paid before the authorities of the country of origin of the foreign satellite system, for the concession of each orbital position used to provide services in the National Territory.
In order for the concessionaires to be able to carry out the operation indicated in the previous paragraph, they must reliably demonstrate to the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones), the payments made to the corresponding authority of the country of origin of the foreign satellite system, for the concession of each orbital position.
In the event that the payment made in the country of origin of the foreign satellite system covers more than one annual period, the Federal Telecommunications Institute (Instituto Federal de Telecomunicaciones) will announce to the concessionaires, as an administrative facility, the equivalent annual payment in national currency, corresponding at the present value of the total amount paid using an annual real discount rate of 2.50 percent, considering the period covered by said payment and the number of megahertz associated with each orbital position of the foreign satellites concession to provide services in the National Territory.
Likewise, the annual amount that has been paid before the authorities of the country of origin of the foreign satellite system, for the concession of each orbital position, must be multiplied by the exchange rate that the Bank of Mexico has published in the Official Journal of the Federation (Diario Oficial de la Federación) the day in which said amount has been paid and additionally it will be updated in the terms of article 17-A of the Federal Fiscal Code (Código Fiscal de la Federación). For the purposes of this article, in no case may payments be accredited for the use of frequency bands that, where appropriate, the concessionaire has made or is making before the authorities of the country of origin of the foreign satellite system. The accreditation referred to in this article will not give rise to any return or compensation.
