ARTICLE 270:

The holders of mining concessions and assignments, as well as the purchasers of duties related to those concessions, will pay the extraordinary mining duty annually, applying the rate of 0.5% to the income derived from the disposal of gold, silver and platinum, by means of a declaration that will be presented to the offices authorized by the Service Tax Administration (Servicio de Administración Tributaria) no later than the last business day of the month of March of the year following the one to which the payment corresponds.

The duty referred to in this article will be calculated considering the total accumulative income of the subjects referred to in the previous paragraph determined in accordance with the provisions of the Law on Income Tax (Ley del Impuesto sobre la Renta), for the alienation or sale of gold, silver and platinum, regardless of the number of concessions, assignments or duties derived from those concessions of which they are holders.

Taxpayers must keep separate account records identifying the income derived from the alienation of gold, silver and platinum.

The payment of the right indicated in this article, will be made independently of the payments of other rights of mining that, where appropriate, proceed according to this Law.

The Service Tax Administration (Servicio de Administración Tributaria) may issue the general provisions necessary for the correct and proper application of this article.
