ARTICLE 269:

     

    The holders of mining concessions that do not carry out exploration and exploitation works and construction duly verified in accordance with the Mining Law (Ley Minera), for two continuous years within the first eleven years of validity, counted from the date of issuance of their respective title of mining concession, they will pay semiannually the additional right on mining in accordance with 50% of the fee indicated in section VI of article 263 of this Law (LFD: Art. 263), per hectare concession.

    In the case of the holders whose concessions are in the twelfth year and later of validity, that do not carry out construction and works of exploration and exploitation for two continuous years, the payment of the right will be 100% of the fee indicated in section VI of article 263 (LFD: Art. 263) cited above, per concession hectare.

    The payment of the right referred to in this article shall be made will be carried out until as long as it is not accredited before the mining authority the realization of works and constructions of exploration or exploitation for two continuous years.

    For the purposes of this article, the payment of the additional right on mining shall be made independently of the payments of other rights on mining that, where appropriate, proceed in accordance with this Law.

    The payment of the right referred to in this article must be made semiannually in the months of January and July of the corresponding year.

    In the event that the determination of compliance with the two-year term referred to in the first and second paragraphs of this article is made during the course of a semester, the concessionaires must pay the proportional part of the right for the corresponding period, from the month in which the period of two years was fulfilled and until the last month of the semester in question, for such purposes, the right must be paid within thirty calendar days following that date.
