ARTICLE 167F: REQUIREMENTS FOR THE CUSTOMS AGENCY TO OPERATE
Customs agencies, in order to operate, must meet the following requirements:
Maintain the main office of their business within the national territory, as well as give the notices of opening and closing of its branches in terms of the Federal Fiscal Code (Código Fiscal de la Federación).
Express to the customs authorities the address of their office to hear and receive notifications in the customs district in which it exercise the authorization of the customs agency, as well as the email address to receive notifications and that of their customs mandataries. The notifications will be made to the address and email, expressed in accordance with this section, will have their effects in the legal terms. Likewise, it shall give notice to customs authorities of the change of address or email address, even in the case of voluntary suspension of activities.
To make known to the customs in which it acts, the names of the employees or dependents authorized to assist it in the procedures of all the customs clearance acts, as well as the names of the customs mandataries that represent it when promoting and processing said clearance. The customs agency will be unlimitedly responsible for the acts of its authorized employees or dependents and its customs mandataries as well as the customs agents that comprise it.
It will be understood that the customs agency is notified when the notification of acts derived from customs recognition (RLA: Art. 2), as well as the inspection or verification of the merchandise, during their stay in the fiscal precinct by virtue of their dispatch, be carried out with any of their partners, employees or authorized dependents, customs mandatary, as well as customs agents already integrated.
Perform the corresponding acts in accordance with this Law for customs clearance (LA: Art. 35) of the merchandise, using the electronic customs system (RLA: Art. 1) and the advanced electronic signature or digital stamp (RLA: Art. 6) to be assigned by the Service Tax Administration (Servicio de Administración Tributaria).
Have the necessary equipment to promote electronic clearance, in accordance with the rules issued by the Service Tax Administration (Servicio de Administración Tributaria) and use it in the activities of its corporate purpose.
To take care of those import and export operations whose value does not exceed that determined by rules by the Service Tax Administration (Servicio de Administración Tributaria) (RGCE 2022: Regla 1.4.9), in each of the customs in which it operates.
Use official or electronic padlocks (RGCE 2022: Regla 1.7.3) (RGCE 2022: Regla 1.7.4) (RGCE 2022: Regla 1.7.5) (RGCE 2022: Regla 1.7.6) on vehicles and containers that transport the merchandise whose customs clearance promotes, in accordance with what is established by the Service Tax Administration (Servicio de Administración Tributaria) by means of rules, as well as prevent locks acquired from importers or authorized manufacturers, are used in containers or vehicles that transport merchandise whose clearance has not been promoted.
Fulfill the assignment conferred on them (LA: Art. 162), cannot transfer it or endorse documents that are in their favor or under their name, without the express written authorization of the person who granted it.
Give notice to the customs authorities within a period not exceeding ten days from the occurrence of the event, when any of the customs agents that integrate it are related by consanguinity in a straight line without limitation of degree and collateral until the fourth degree, or by affinity, with the administrator or any of the sub-administrators of any of the customs in which it operates. In this case, the customs agent who has the aforementioned relationship will refrain from intervening in the operations that the customs agency dispatches in the respective customs, since the event occurs.
Inform the customs authorities within a period not exceeding ten days after the act, the incorporation and removal of partners of the agency is formally carried out.
