RULE 1.12.5: DESIGNATION OF APPLICANT OF CUSTOMS AGENT, IN CUSTOMS AGENCY IN PROCESS

    For the purposes of articles 167-D and 167-E of the Law, First, Fourth and Fifth Transitory of the "Decree by which they are amended, added and repealed various provisions of the Customs Law (Ley Aduanera)", published in the Official Journal of the Federation (Diario Oficial de la Federación) on June 25, 2018 , when a customs agent who has submitted the authorization request referred to in rules 1.12.1. and 1.12.2. , respectively, complying with the requirements and conditions set forth in the applicable legal provisions, dies or retires due to disability, without the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas) having notified the corresponding resolution in terms of rule 1.12.1, third paragraph , it will be as follows:

    I. Interested customs agents who are part of civil company or authorized customs agency, may complete the respective procedure, provided that their interest is confirmed and ratified, complying with the provisions of procedure file 17 / LA (Customs Law) of Annex 1-A .

    If the aforementioned confirmation and ratification is not made, the request for authorization to operate as a customs agency will be deemed not submitted.

    II. Once the above is complied with and, where appropriate, having obtained the official letter in which the authorization to operate as a customs agency is granted, in accordance with article 167-K of the Law, two of them may be appointed from among its active mandataries or managing partners to participate in the contest to obtain the patent of the customs agent who died or retired, complying with the provisions of rule 1.12. 13 .

    The authorized customs agency whose customs agent died or retired due to permanent disability and exercised the facility provided for in rule 1.4.14, waiving to continue with the procedure provided in rule 1.4.13, both of the General Rules of Foreign Trade (Reglas General del Comercio Exterior) for 2019, may during the fiscal year 2020 and 2021, designate the applicant for customs agent who has an official letter issued by the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas) stating that it meets the requirements to be recognized as such and is a managing partner of said agency, to participate in the contest to obtain the patent of the customs agent who died or retired, complying with the provisions of rule 1.12.13.

    In the event that the patent of the deceased or retired customs agent is not submitted to competition, in terms of this rule, it will be canceled.
