ARTICLE 166: CUSTOMS AGENT PATENT EXTINCTION CAUSES

     

    The right to exercise the customs agent patent will be extinguished when:

  • Stop satisfying one of the requirements indicated in article 159 of this Law (LA: Art. 159), for more than ninety business days, without just cause, counted from the time the authority becomes aware of the facts or omissions that configure it.
  •  

  • The customs agent ceases to exercise the patent for more than one year, except in the case of suspension of activities that have been authorized by the customs authority.
  •  

    For the purposes of the foregoing, the competent authority must be subject to the procedure referred to in article 167 of this Law (LA: Art. 167), as well as the provisions of articles 167-A, 167-B and 167-C. (LA: Art. 167A) (LA: Art. 167B) (LA: Art. 167C)

    In case of death of the customs agent, the mandatary referred to in article 163, section IV of this Law (LA: Art. 163) that it gives notice to the customs authority (RGCE 2022: Regla 1.4.11) within five days after the death and accompanies a copy of the death certificate, it will be able to carry out the necessary procedures to conclude the operations covered by the customs declarations (pedimentos) that had been validated and paid before the date of death, within a period not exceeding two months.

    The customs agent who joins a customs agency in terms of the provisions of article 167-D of this Law (LA: Art. 167D), may request their voluntary withdrawal (LA: Art. 2) at any time, as long as it is not subject to a disqualification procedure (LA: Art. 160), suspension (LA: Art. 164), cancellation (LA: Art. 165) or termination of their patent.
