    • ARTICLE 185: FINES APPLICABLE TO THE INFRINGEMENTS OF ARTICLE 184

     

    The following fines will be applied to those who commit the infractions related to the obligations of presenting documentation and declarations, as well as of electronic transmission of the information, foreseen in article 184 of this Law (LA: Art. 184):

  • Fine of $3,730.00 to $5,590.00, in case of omission to those mentioned in sections I and ll. Fines will be reduced to 50% when the presentation is extemporaneous.

  • Fine of $1,800.00 to $2,570.00 as indicated in section III, for each document. (RGCE 2022: Regla 3.7.25) (RGCE 2022: Regla 3.7.26) (RGCE 2022: Regla 1.6.2) (RGCE 2022: Regla 6.2.1)

    •  

  • Fine of $3,100.00 to $5,180.00 in the case of section IV.

    •  

  • Fine of $4,150.00 to $6,210.00 as indicated in section V, for each magnetic medium containing inaccurate, incomplete, or false information.

    •  

  • Fine of $3,860.00 to $6,430.00 as indicated in section VI.

    •  

  • Fine of $3,850.00 to $6,400.00, in the case indicated in section VII, for each customs declaration (pedimento) (LA: Art. 2) or for each consolidated notice (LA: Art. 2) or corresponding customs document.

    •  

  • Fine equivalent to 20% to 40% of the amount that exceeds the equivalent in the currency or currencies in question to ten thousand U.S. dollars, for the infractions established in sections VIII, XV and XVI. (RGCE 2022: Regla 3.7.17)

    •  

  • A fine of $74,100.00 to $111,200.00, in the case of the electronic transmission indicated in section IX, for the omission (RGCE 2022: Regla 1.9.7) of each passenger, crew or means of transport that arrives in national territory, to which refers to subsection a) and for the omission relating to the merchandise for each means of transport referred to in subsection b). The fine will be reduced by 50%, in the event that the electronic transmission is extemporaneous, incomplete or contains incorrect information. (RGCE 2022: Regla 1.9.7) In cases where more than one infraction is incurred associated with the arrival of the same means of transport, the authority shall establish up to a maximum of six fines per event.

  • A fine of $207,370.00 to $311,050.00, in the cases indicated in section X, for each aircraft that arrives in national territory.

    •  

  • A fine of $2,570.00 to $3,860.00, in the case indicated in section XI, for each customs declaration (pedimento).

    •  

  • A fine of $7,710.00 to $10,280.00 in case of omission and $ 3,860.00 to $ 6,430.00 for the extemporaneous presentation, in the case indicated in section XII.

    •  

  • Fine of $1,290.00 to $2,570.00, in the case indicated in section XIII, for each document.

    •  

  • Fine equivalent from 2% to 10% of the commercial value of the merchandise, as indicated in section XIV.

    •  

  • A fine of $16,700.00 to $25,050.00, as indicated in section XVII, in case of not presenting the notice within the established term.
