    • ARTICLE 187: FINES APPLICABLE TO THE INFRINGEMENTS OF ARTICLE 186

     

    The following sanctions will be applied to those who commit the infractions related to the control, security, and handling of the merchandise provided in article 186 of this Law (LA: Art. 186):

  • Fine of $7,420.00 to $10,200.00, as indicated in sections I, II, IV, V, Xl, XXI and XXII.

    •  

  • Fine of $2,070.00 to $3,120.00, as indicated in section III.

    •  

  • Fine equivalent of 70% to 100% of omitted contributions and compensatory fees, when the corresponding payment or of 30% to 50% of the commercial value of the merchandise has not been covered if they are exempt or if they are returned abroad, as indicated in section VI.

    •  

  • Fine of $20,850.00 to $31,2600.00, as indicated in section IX.

    •  

  • Fine of $12,440.00 to $16,580.00, as indicated in sections Xll and Xlll.

    •  

  • Fine of $74,200.00 to $111, 310.00, as indicated in section Vlll.

    •  

  • Closure of the establishment for one week on the first occasion, for two weeks on the second occasion, for three weeks on the third and subsequent occasions within each calendar year, as indicated in section XV of article 186 of this Law. (LA: Art. 186)

    •  

  • Fine of $41,480.00 to $82,950.00 as indicated in section XVl.

    •  

  • Fine from 3% to 5% of the total amount that would not have been transferred, as indicated in section XVIII.

    •  

  • Fine of $102,810.00 to $141,360.00, as indicated in section XIX.

    •  

  • Fine of $1,290.00 to $2,570.00, as indicated in section XVII.

    •  

  • Fine of $463,770.00 to $742,040.00, to that indicated in section XX, for each period of 20 days or fraction that elapses from the date on which the obligation was to be fulfilled and until it is fulfilled.

    •  

  • Fine equivalent to 80% to 100% of the contributions and compensatory fees that would have been omitted, when the corresponding payment was not covered or from 30% to 50% of the commercial value of the merchandise if they are exempt or if they are returned to foreign, as indicated in section VII. In the case of recidivism, the sanction will consist of the provisional suspension of the controlled premises for a period of two to thirty days.

    •  

  • Fine of $74,200.00 to $111,310.00, as indicated in section XIV. In the case of recidivism, the sanction will consist of the provisional suspension from the controlled premises for a period of two to thirty days.

    •  

  • Fine of $927,530.00 to $1,855,080.00 as indicated in section XXIII.

    •  

    In the case of the provisional suspension periods referred to in sections XIII and XIV of this article, the owner of the controlled premises may only conclude the operations that were initiated at the date on which the suspension order was notified, during said period it cannot start new operations.
