RULE  1.9.11:  TRANSMISSION  OF  INFORMATION  BY  RAIL  TRANSPORT  CONCESSIONAIRES

For  the  purposes  of  articles  20,  sections  III  and  VII  --199-Art.  20--  of  the  Law  and  33  --13-Art.  33--  of  the  Regulation,  the  rail  transport  concession  companies  that  carry  out  operations  in  the  northern  border  of  the  country,  must  transmit  electronically  to  the  Digital  Window,  in  accordance  with  the  "Technical  Guidelines  for  the  dispatch  of  foreign  trade  merchandise  by  means  of  rail  transport"  issued  by  the  General  Customs  Administration  (Administración  General  de  Aduanas),  which  can  be  consulted  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal,  the  following:

I.  Electronic  document  with  the  information  of  the  merchandise  that  enter  or  leave  the  national  territory,  as  well  as  the  means  in  which  they  are  transported,  with  the  following  data:

a)  Carrier  code.

b)  Place  of  loading  of  the  merchandise,  total  quantity  and  gross  weight  of  the  merchandise  indicated  in  the  transport  document.

c)  Details  of  the  shipper,  consignee,  and  customs  agent,  or  customs  representative,  or  customs  agency,  or  importer  or  exporter.

d)  Transport  document  number.

e)  Quantity,  description,  gross  weight,  identification  numbers  and  brand,  when  these  exist,  for  each  of  the  merchandise  transported.

f)  Railway  equipment  data:  initials,  number,  type,  and  status  (empty  or  loaded)  and  numbers  of  stamps,  seals,  or  padlocks  when  placed  by  the  rail  transport  concessionaire.

g)  In  the  case  of  dangerous  merchandise,  indicate  the  description,  the  United  Nations  number,  as  well  as  the  name  of  a  contact  person  and  their  telephone  number,  in  case  of  emergencies.

Once  the  information  has  been  transmitted,  the  Digital  Window  will  send  an  electronic  validation  acknowledgment  to  the  rail  transport  concessionaire.

The  data  transmitted  may  be  modified  as  many  times  as  necessary  by  the  rail  transport  concession  company,  in  accordance  with  the  "Technical  Guidelines  for  the  dispatch  of  foreign  trade  merchandise  by  means  of  rail  transport"  issued  by  the  customs  authority,  which  can  be  consulted  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal.

II.  Electronic  document  with  the  arrival  notice,  in  the  case  of  the  departure  of  merchandise  from  the  national  territory,  which  must  be  transmitted  before  the  arrival  of  the  railway  to  the  exit  customs,  with  the  information  of  the  railway  equipment,  with  the  following  data:

a)  Carrier  code.

b)  Country  of  origin.

c)  Train  identification  number.

d)  Port  of  departure.

e)  Date  and  time  of  arrival.

f)  Railway  equipment  data:  initials,  number,  type,  and  status  (if  it  is  empty  or  loaded).

g)  Transport  document  numbers.

The  transmission  of  the  arrival  notice  must  be  made  two  hours  before  the  arrival  of  the  railway  equipment  at  the  customs  of  departure  and  may  be  transmitted  up  to  twelve  hours  before.

Likewise,  the  arrival  notice  must  be  transmitted  prior  to  the  electronic  presentation  of  the  exchange  list  referred  to  in  section  III  of  this  rule,  provided  that  the  customs  agent,  customs  representative,  customs  agency,  or  exporter  files  the  customs  declarations  (pedimentos),  Customs  Declaration  (Pedimento)  Part  II,  or  consolidated  notice,  pursuant  to  rule  3.1.22.  --320-Regla  3.1.22--

Once  the  arrival  notice  is  transmitted,  the  automated  selection  mechanism  will  be  understood  to  have  been  activated,  electronically  sending  the  result  to  the  rail  transport  concession  companies.

III.  Electronic  document  with  the  exchange  list  with  the  information  of  the  railway  equipment,  in  accordance  with  the  provisions  of  the  penultimate  paragraph  of  rule  4.2.14.  --329-Regla  4.2.14--,  with  the  following  information:

a)  Carrier  code.

b)  Country  of  origin.

c)  Train  identification  number.

d)  Place  of  entry  /  exit.

e)  Estimated  date  and  time  of  arrival.

f)  Railway  equipment  data:  initials,  number,  type,  and  status  (if  it  is  empty  or  loaded).

g)  Number  of  transport  documents.

The  transmission  of  the  exchange  list  will  conform  to  the  following:

I.  In  the  case  of  the  entry  of  merchandise  into  the  national  territory,  it  must  be  done  once  the  customs  agent,  customs  representative,  customs  agency  or  importer  submits  the  customs  declarations  (pedimentos),  Part  II  Customs  Declaration  (Pedimento)  or  consolidated  notice  in  accordance  with  rule  3.1.22.  --320-Regla  3.1.22--,  at  least  30  minutes  before  the  crossing  of  the  railway  equipment,  with  which  the  process  of  activating  the  automated  selection  mechanism  begins.

Once  the  railway  equipment  crosses  national  territory  and  the  customs  authority  confirms  the  arrival  of  the  same  or  the  merchandise,  or  both,  in  accordance  with  the  provisions  of  the  "Technical  Guidelines  for  the  dispatch  of  foreign  trade  merchandise  by  means  of  rail  transport"  issued  by  the  customs  authority,  which  can  be  consulted  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal,  the  automated  selection  mechanism  will  be  understood  to  be  activated,  electronically  sending  the  result  to  the  rail  transport  concession  companies  and  to  the  customs  agent,  customs  agency  or  customs  representative.

II.  In  the  case  of  the  departure  of  merchandise  from  the  national  territory,  it  must  be  carried  out  after  the  transmission  of  the  arrival  notice  and  before  the  railway  equipment  crosses  to  leave  the  national  territory,  notifying  the  customs  agent,  customs  agency,  or  customs  representative  of  the  result  of  the  mechanism  of  selection.

Once  the  railway  equipment  leaves  the  national  territory,  and  the  customs  authority  confirms  the  departure  of  the  same  or  the  merchandise,  or  both,  the  customs  clearance  formalities  will  be  considered  completed.

Once  the  concessionary  rail  transport  company  transmits  the  exchange  list,  the  Digital  Window  will  send  a  successful  acknowledgment  of  receipt.

The  data  transmitted  may  be  modified  as  many  times  as  necessary  in  accordance  with  the  "Technical  guidelines  for  the  dispatch  of  foreign  trade  merchandise  by  means  of  rail  transport"  issued  by  the  customs  authority,  which  can  be  consulted  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal.

The  electronic  transmissions  referred  to  in  this  rule  may  be  carried  out  through  the  Digital  Window  to  the  extent  that  the  computer  systems  are  gradually  enabled  in  each  customs  in  the  country,  which  will  be  announced  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal.  In  the  authorized  customs  it  will  no  longer  be  necessary  for  the  rail  company  to  carry  out  the  transmission  provided  for  in  rule  1.9.12.  --312-Regla  1.9.12--
