RULE 3.1.22: TRANSMISSION PROCEDURE IN RAILWAY OPERATIONS WITH CUSTOMS DECLARATIONS (PEDIMENTOS) PART II

    For the purposes of articles 36 (LA: Art. 36), 36-A (LA: Art. 36A), 37 (LA: Art. 37), 37-A (LA: Art. 37A) and 43 (LA: Art. 43), first paragraph of the Law, in the case of operations carried out on the northern border of the country by means of railway, provided for in rule 1.9.11. (RGCE 2020: Regla 1.9.11), the customs agent, the customs agency, or the customs representative, the importer or exporter, must submit, by transmitting an electronic document to the Digital Window, the information of the duly validated and paid customs declaration (pedimento), Customs Declaration (Pedimento) Part II, referred to in the second paragraph, section I of rule 3.1.21. (RGCE 2020: Regla 3.1.21), or the consolidated notice in the case of consolidated customs declarations (pedimentos), which cover the merchandise to be dispatched, containing the following information:

    I. Customs declaration (pedimento) number.

    II. Number of acknowledgment of value and consecutive number of the consignment assigned by the customs agent, customs agency, or customs representative, by importer or exporter, in the case of consolidated customs declarations (pedimentos) or, where appropriate, number of Customs Declaration (Pedimento) Part II in the case of operations provided for in rule 3.1.21, section I (RGCE 2020: Regla 3.1.21).

    III. Permit or certificate number, e-document number according to rule 3.1.31. (RGCE 2020: Regla 3.1.31), when appropriate, name of the agency, in the case of merchandise that is subject to inspection by another authority other than customs.

    IV. Railway equipment number.

    V. Quantity of merchandise in commercial unit of measure and value in dollars.

    VI. Carrier code and transport document number.

    The presentation referred to in this rule must be made with the e.signature of the customs agent, customs agency, or customs representative, of the importer or exporter.

    In the case of merchandise contained in the same railway equipment covered by several consolidated customs declarations (pedimentos) or notices of consolidated customs declarations (pedimentos), processed by the same customs agent, customs agency or customs representative, importer or exporter, they must be presented in a single transmission, so the Digital Window will generate a single acknowledgment number.

    Once the information is transmitted, the Digital Window will provide a reference acknowledgment number called the electronic clearance number.

    The transmitted data referred to in this rule may be modified as many times as necessary, as long as it is carried out before receiving the successful receipt referred to in sections II, in the case of merchandise departure and III , in the case of the entry of merchandise.

    For the purposes of this rule, it will not be necessary the physical presentation of the customs declaration (pedimento), printing of the "Simplified Form of Customs Declaration (Pedimento)", Customs Declaration (Pedimento) Part II, acknowledgment of value or the "Consolidated Notice Format" of Annex 1 (RGCE 2020: Anexo 1). Likewise, with the presentation indicated in the first paragraph of this rule, the transmission will be considered completed referred to in article 37-A, section I (LA: Art. 37A) of the Law.

    The electronic transmission referred to in the first paragraph of this rule, through the Digital Window, may be carried out to the extent that the computer systems are gradually enabled in each customs in the country, which will be announced on the Service Tax Administration (Servicio de Administración Tributaria) Portal. Once it can be carried out, it will no longer be necessary for customs agents, customs agencies or customs representative to physically present the customs declaration (pedimento), the consolidated customs declaration (pedimento), the "Consolidated Notice Format" of Annex 1 (RGCE 2020: Anexo 1), or the Customs Declaration (Pedimento) Part II.
