RULE  3.5.12:  REGISTRATION  OF  COMPANIES  PROVIDING  BACKGROUND  INFORMATION  ON  USED  VEHICLES  AND  RENEWAL

For  the  purposes  of  section  XIII,  of  rule  1.8.2.  --311-Regla  1.8.2--,  the  General  Customs  Administration  (Administración  General  de  Aduanas)  may  grant  the  registration  in  the  registry  of  companies  that  provides  the  background  information  of  used  vehicles  and,  where  appropriate,  its  renewal,  to  the  interested  parties  who  submit  the  corresponding  request,  in  accordance  with  procedure  file  76  /  LA  (Customs  Law)  of  Annex  1-A  --356-Anexo  1A--  and  comply  with  the  following:

I.  Companies  residing  abroad  must  prove  through  public  information  available  that  they  are  a  company  that  provides  the  background  information  of  used  vehicles  from  the  country  of  origin.

Similarly,  the  companies  referred  to  in  the  previous  paragraph  must  prove  that  they  are  listed  on  recognized  markets  or  that  they  belong  to  corporations  listed  on  said  markets,  in  accordance  with  the  provisions  of  article  16-C,  section  II  --610-Art.  16C--,  of  the  Federal  Fiscal  Code  (Código  Fiscal  de  la  Federación).

In  the  case  of  companies  incorporated  in  accordance  with  Mexican  legislation,  must  prove  that  they  have  an  exclusive  contract  in  national  territory  to  provide  the  same  services  as  the  provider  abroad,  provided  that  it  complies  with  the  characteristics  indicated  in  this  section.

II.  Have  information  systems  for  online  consultation,  which  will  be  used  in  comparison  by  the  customs  authority.  For  this  reason,  exporters,  importers,  authorized  to  provide  electronic  data  pre-validation  services,  contained  in  the  customs  declaration  (pedimento),  in  accordance  with  rule  1.8.1.  --311-Regla  1.8.1--  and  customs  agents  or  customs  agencies,  may  not  supply  or  provide  information  to  companies  that  provide  background  information  of  used  vehicles,  in  order  to  guarantee  the  reliability  of  the  information.  Likewise,  the  consultation  or  use  of  said  information  should  not  be  conditioned  on  vehicles  for  export  to  Mexico  or  the  use  of  an  intermediary  or  third  party.

III.  When  the  services  are  offered  in  the  United  States  of  America  and  Canada,  the  processed  information  contained  in  its  database  must  cover  all  states  of  the  United  States  of  America  and  all  states  of  Canada.  In  the  event  that  the  services  are  offered  only  in  one  of  the  reference  countries,  the  processed  information  contained  in  its  database  must  cover  all  the  states  of  the  corresponding  country.  Said  coverage  must  be  published  on  the  company's  official  website.

IV.  Prove  that  they  have  a  vehicle  purchase  program  (buyback  program)  in  case  of  errors  or  omissions  regarding  their  information,  which  must  be  valid  in  the  country  of  origin  and  published  on  the  official  website  of  the  company,  without  conditioning  the  guarantee  to  only  vehicles  that  are  going  to  be  exported  to  national  territory  or  that  the  guarantee  only  applies  through  the  use  of  an  intermediary  or  third  party.

V.  The  information  that  it  issues  and  that  must  be  provided  to  the  competent  authorities  and  those  authorized  to  provide  the  services  of  electronic  pre-validation  of  data,  contained  in  the  customs  declaration  (pedimento),  that  corresponds,  for  the  confirmation  inquiry  regarding  the  used  vehicles  subject  to  import,  in  accordance  with  article  6  of  the  Decree  of  Used  Vehicle,  as  well  as  rule  3.5.1,  section  II,  subsection  g),  numeral  2  --324-Regla  3.5.1--,  it  must  show  at  least:

a)  Odometer  reading,  which  detects  possible  alterations  to  it.

b)  History  of  total  loss.

c)  Rescue  history.

d)  Report  of  theft  in  the  country  of  origin.

e)  Vehicle  history  in  terms  of  physical-mechanical  inspection.

f)  Vehicle  history  in  terms  of  gas  emission  compliance.

g)  Number  of  the  property  title  or  titles,  by  date  or  number.

h)  Registration  or  vehicle  plates  with  the  capacity  to  verify  its  validity,  its  coincidence  with  the  title  and  the  vehicle  that  is  physically  intended  to  be  imported.

In  the  corresponding  fields,  the  required  information  mentioned  above  must  be  stated.  In  the  event  that  the  field  is  empty,  it  will  be  understood  as  non-existent  without  prejudice  to  the  faculties  of  verification  of  the  customs  authority.  The  responsibility  that  the  reports  have  the  information  will  be  of  the  companies  that  provide  the  background  information  of  used  vehicles  that  have  the  registration  granted  by  the  General  Customs  Administration  (Administración  General  de  Aduanas)  in  terms  of  this  rule.

In  the  event  that  possible  irregularities  are  detected  in  the  information  contained  in  the  company's  databases,  non-compliance  with  the  requirements  for  granting  this  registration  or  obligations  inherent  to  the  registration,  the  customs  authority  will  require  that,  within  a  period  of  10  days,  counted  from  the  notification  of  the  request,  provide  the  documentation  and  information  that  distorts  them.  When  it  is  not  provided  within  the  indicated  period,  or  the  information  or  documentation  does  not  detract  from  the  possible  irregularity,  the  cancellation  of  its  registration  will  be  notified.

Derived  from  the  cancellation  of  the  registration,  the  company,  its  partners  and  shareholders,  will  not  be  able  to  request  a  new  registration  under  this  rule  within  a  period  of  3  years,  counted  from  the  date  of  the  cancellation  resolution.

The  companies  that  provide  the  background  information  of  used  vehicles  that  have  the  registry  referred  to  in  this  rule,  may  request  the  Central  Administration  of  Customs  Legal  Support  (Administración  Central  de  Apoyo  Jurídico  de  Aduanas)  that  it  be  left  without  effect.

The  companies  that  provide  background  information  on  used  vehicles  to  whom  the  registration  referred  to  in  this  rule  has  been  granted,  before  transmitting  the  data  issued  for  the  confirmation  inquiry  regarding  the  used  vehicles  subject  to  import  in  accordance  with  article  6  of  the  Decree  of  used  vehicles,  as  well  as  of  rule  3.5.1,  section  II,  subsection  g),  numeral  2  --324-Regla  3.5.1--,  they  must  present  the  following  to  the  Central  Administration  of  Customs  Legal  Support  (Administración  Central  de  Apoyo  Jurídico  de  Aduanas):

I.  Copy  of  the  legal  instrument  through  which  the  electronic  transmission  of  used  vehicle  data  is  formalized  between  the  company  that  provides  the  background  information  of  used  vehicles  and  the  legal  entity  (s)  that  provides  the  service  of  electronic  pre-validation  of  data,  contained  in  the  customs  declarations  (pedimentos).

II.  Information  related  to  the  registration  and  cancellation  of  the  legal  entity  (s)  who  provide  the  electronic  data  pre-validation  service,  contained  in  the  customs  declarations  (pedimentos)  with  which  an  agreement  is  reached  for  the  transmission  of  data  information  of  used  vehicles.

The  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  will  publish  on  its  Portal  the  name,  denomination  or  company  name  of  the  companies  that  provide  background  information  for  used  vehicles  abroad  that  have  the  registration  provided  for  in  this  rule,  as  well  as  the  legal  entity  (s)  that  provides  the  electronic  data  pre-validation  service,  contained  in  the  customs  declarations  (pedimentos),  with  which  each  company  has  an  agreement  for  the  electronic  transmission  of  data  of  used  vehicle.
