RULE  4.2.7:  TEMPORARY  IMPORTATION  OF  VEHICLES  OF  VISITORS  AND  PEOPLE  OF  THE  SAME  COUNTRY

For  the  purposes  of  articles  61,  section  III  --206-Art.  61--,  106,  sections  II,  subsection  e)  and  IV,  subsection  a)  of  the  Law  --218-Art.  106--,  108,  section  V  --39-Art.  108--  and  158  --50-Art.  158--  of  the  Regulation,  will  authorize  BANJERCITO  to  operate  the  CIITEV  Modules,  carry  out  the  procedures  and  control  of  temporary  imports  of  vehicles  in  printed  or  digital  format,  issue  the  corresponding  customs  documentation,  receive  payment  for  the  procedure  for  temporary  importation  of  vehicles  and  the  applicable  warranty.

Foreigners  or  Mexicans  residing  abroad  may  carry  out  the  temporary  importation  of  vehicles,  provided  that  they  also  comply  with  the  provisions  of  Article  158  --50-Art.  158--  of  the  Regulation  with  the  following:

I.  Mexicans  residing  abroad,  as  well  as  those  who  prove  that  they  are  working  abroad  for  a  year  or  more,  may  temporarily  import  a  single  vehicle  in  each  12-month  period,  having  to  present  for  such  purposes,  the  document  issued  by  the  authority  immigration  of  the  foreign  country  that  accredits  them  as  permanent  or  temporary  residents  abroad,  or  the  express  authorization  of  the  competent  authority  of  that  country  that  grants  them  the  quality  of  service  providers  in  accordance  with  the  international  agreements  to  which  Mexico  is  a  part  of.

II.  In  the  case  of  foreigners  with  condition  of  stay  of  visitors,  temporary  resident,  temporary  resident  student,  may  temporarily  import  a  single  vehicle,  having  to  present  their  valid  passport  or  passport  card  and  the  official  document  issued  by  the  immigration  authority.

III.  Guarantee  the  tax  credit  that  may  be  caused  by  the  omission  of  the  return  of  the  vehicle  within  the  authorized  period,  without  prejudice  to  the  applicable  sanctions  for  the  commission  of  the  other  infractions  provided  for  in  the  applicable  laws,  through  a  deposit,  for  an  equivalent  amount  in  national  currency,  that  corresponds  according  to  the  following  table:

IV.  Cover  in  favor  of  BANJERCITO  the  payment  for  the  procedure  for  the  temporary  importation  of  vehicles.

Those  vehicles  that  are  or  have  been  reported  in  the  United  States  of  America  or  Canada  as  damaged,  restricted,  or  prohibited  for  circulation  in  accordance  with  rule  3.5.1,  section  II,  subsection  f)  --324-Regla  3.5.1--;  those  reported  as  stolen  in  those  countries;  those  who  do  not  have  valid  foreign  plates;  those  whose  plates  do  not  coincide  with  those  indicated  on  the  vehicle  title  deed  or  with  the  vehicle  that  is  physically  presented;  those  who  do  not  have  a  valid  document  proving  foreign  circulation,  or  those  who  have  not  approved  the  pollutant  emission  inspection  in  the  country  of  origin,  where  appropriate,  may  not  be  temporarily  imported  into  national  territory;  Therefore,  BANJERCITO,  prior  to  the  issuance  of  the  Temporary  Import  Permit,  will  carry  out  the  necessary  consultations  and  must  electronically  safeguard  the  result  of  said  consultation,  for  at  least  5  years.

In  the  event  that  the  vehicle  does  not  meet  the  conditions  to  be  imported  temporarily,  the  BANJERCITO  will  not  issue  the  Temporary  Import  Permit.

The  procedure  and  payment  to  obtain  the  temporary  import  permit  for  the  corresponding  vehicle,  as  well  as  the  guarantee  deposit,  must  be  made  in  the  form  of  payment  provided,  depending  on  the  place  where  said  permit  is  acquired,  being  in:

I.  The  CIITEV  Modules  located  in  the  customs  of  entry  to  national  territory;  An  amount  equivalent  of  51  (fifty-one  dollars)  plus  the  Value-Added  Tax  (Impuesto  al  Valor  Agregado)  must  be  covered  in  national  currency,  payment  may  be  in  cash,  or  with  an  international  credit  or  debit  card,  in  the  name  of  the  importer.

II.  CIITEV  modules  installed  at  the  Mexican  Consulates  located  in  the  United  States  of  America,  in  Chicago,  Illinois;  in  Austin,  Dallas  and  Houston,  Texas;  in  Los  Angeles,  San  Bernardino  and  Sacramento,  California;  in  Albuquerque,  New  Mexico;  in  Denver,  Colorado  and  in  Phoenix,  Arizona;  an  amount  equivalent  of  51  (fifty-one  dollars)  plus  the  Value-Added  Tax  (Impuesto  al  Valor  Agregado)  must  be  covered  in  national  currency,  payment  will  only  be  done  by  international  credit  or  debit  card,  in  the  name  of  the  importer.

The  interested  party  may  process  their  permit  up  to  6  months  before  the  date  of  entry  of  the  vehicle  to  national  territory.

III.  Via  the  internet,  through  the  electronic  page,  www.gob.mx/banjercito  or  on  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal,  an  amount  equivalent  of  45  (forty-five  dollars)  plus  Value-Added  Tax  (Impuesto  al  Valor  Agregado)  must  be  covered  in  national  currency,  payment  will  only  be  done  by  international  card  or  debit  credit,  in  the  name  of  the  importer.

The  interested  party  may  process  their  permit  within  a  period  of  between  10  and  60  days  before  the  date  of  entry  of  the  vehicle  into  national  territory.

It  will  be  the  sole  responsibility  of  the  importer,  to  verify  the  correct  and  adequate  registration  of  the  requested  data,  to  comply  with  the  requirements  and  conditions  established  for  the  temporary  importation  of  the  vehicle,  as  well  as  to  send  digitally  to  BANJERCITO  a  simple  copy  of  the  documentation  that  covers  the  requirements  established  in  this  rule,  said  documents  must  be  sent  in  digital  files  at  the  time  of  processing;  once  the  documentation  has  been  received,  BANJERCITO  may  start  the  process  of  issuing  the  permit.

The  BANJERCITO  will  send  the  interested  party  electronic  confirmation  of  the  procedure  and  within  a  period  of  no  more  than  7  days  after  the  confirmation,  will  send  the  corresponding  temporary  import  permit  to  the  address  indicated  by  the  interested  party.

IV.  Via  mobile  application  that  is  downloaded  to  be  installed  and  executed  on  devices  such  as  smartphones,  tablets,  among  others,  through  the  website  www.gob.mx/banjercito,  an  amount  equivalent  of  45  (forty  and  five  dollars)  plus  Value-Added  Tax  (Impuesto  al  Valor  Agregado),  payment  will  only  be  made  by  international  credit  or  debit  card,  in  the  name  of  the  importer.

The  interested  party  may  process  their  permit  within  a  period  of  between  10  and  60  days  prior  to  the  date  of  entry  of  the  vehicle  into  national  territory.

It  will  be  the  sole  responsibility  of  the  importer  to  verify  the  correct  and  adequate  registration  of  the  requested  data,  to  comply  with  the  requirements  and  conditions  established  for  the  temporary  importation  of  the  vehicle,  as  well  as  to  send  in  digital  files  to  BANJERCITO,  during  the  process  to  obtain  the  permit,  the  documentation  that  covers  the  requirements  established  in  this  rule;  once  the  documentation  has  been  received,  the  BANJERCITO  may  start  the  process  of  issuing  the  permit.

If  the  request  is  appropriate,  BANJERCITO  will  send  the  interested  party  electronic  confirmation  of  the  procedure  and  will  simultaneously  send  to  the  email  indicated  by  the  interested  party,  the  temporary  import  permit  in  digital  document.

The  period  authorized  to  return  vehicles  that  have  been  temporarily  imported  by  Mexicans  residing  abroad,  will  be  180  calendar  days  of  effective  stay  in  the  country,  computable  from  the  date  of  entry  of  the  vehicle  into  national  territory  and  usable  in  a  period  of  12  months,  considering  multiple  entries  and  exits,  covered  at  all  times  by  the  existing  warranty.

The  period  authorized  to  return  vehicles  that  have  been  temporarily  imported  by  foreigners  in  accordance  with  section  II  of  the  second  paragraph  of  this  rule  will  be  that  of  the  validity  of  their  condition  of  stay  and  their  renewals,  provided  that  there  is  continuity  between  them.

In  the  event  that  the  temporary  resident  and  the  temporary  resident  student  renew  their  stay  in  national  territory,  the  validity  of  the  temporary  import  permit  of  the  vehicle  will  be  accredited  with  the  official  document  issued  by  the  immigration  authority,  without  requiring  authorization  from  the  customs  authorities;  Likewise,  in  order  that  the  guarantee  granted  in  the  terms  of  this  rule  does  not  become  effective,  within  the  15  days  following  the  authorization  in  which  the  exchange  or  renewal  of  their  status  as  a  temporary  resident  or  temporary  resident  student,  must  present  before  any  customs  in  the  country  or  to  the  Central  Administration  of  Customs  Operation  (Administración  Central  de  Operación  Aduanera),  a  notice  stating  said  circumstance,  attaching  the  receipt  that  proves  said  authorization  and  the  temporary  import  permit  of  the  vehicle;  Said  notice  must  be  presented  at  the  time  of  definitive  return  of  the  vehicle.

In  the  issuance  of  permits  in  CIITEV  Modules  located  in  the  Consulates  of  Mexico,  via  the  internet  or  via  mobile,  when  the  vehicle  for  which  the  temporary  import  permit  has  been  granted  suffers  an  accident,  theft,  confiscation,  seizure  or  sale,  in  their  place  of  origin  and  on  a  date  prior  to  the  beginning  of  the  validity  of  the  Temporary  Import  Permit,  the  interested  party  must  present  to  the  BANJERCITO  staff  located  in  the  CIITEV  Modules,  at  the  authorized  Consulates  or  send  by  certified  mail  to  the  Central  Administration  of  Customs  Operation  (Administración  Central  de  Operación  Aduanera),  a  free  letter  in  the  which  states  that  it  wishes  to  withdraw  from  the  permit  granted  and  requests  the  return  of  the  guarantee  granted,  declaring,  under  protest  of  telling  the  truth,  the  facts,  motives  or  circumstances  by  which  it  is  considered  that  the  vehicle  will  not  enter  national  territory,  attaching  the  Import  Permit  temporary  issued  for  such  purposes,  as  well  as  the  certificate  issued  abroad  by  the  Police  Department  or  Department  of  Motor  Vehicles  (DMV  for  its  acronym  in  English),  which  proves  said  circumstance,  in  which  the  VIN  of  the  vehicle  in  question  is  stated  and,  where  appropriate,  that  the  physical  presence  of  the  same  has  been  verified.

In  the  event  that  the  authorized  term  expires  and  the  temporarily  imported  vehicle  does  not  return  abroad,  the  BANJERCITO  will  transfer  to  the  Treasury  of  the  Federation  (Tesorería  de  la  Federación)  in  national  currency,  the  amount  of  the  guarantee  effectively  collected,  no  later  than  the  second  banking  business  day  following  the  one  in  which  the  term  of  temporary  importation  has  expired.

When  the  vehicle  to  be  temporarily  imported,  towing  or  transporting  a  boat  of  up  to  four  and  a  half  meters  in  length  including  the  trailer  for  transport,  recreational  cars,  motorcycles,  tri  moto,  ATVs  or  jet  skis,  which  have  not  been  conceived,  intended  or  manufactured  to  circulate  through  the  general  communication  routes,  the  temporary  importation  of  the  same  may  be  authorized,  provided  that  the  sum  of  said  merchandise  towed  or  transported  does  not  exceed  3  units  and  the  importer  proves  their  ownership;  for  which  the  BANJERCITO  staff  must  register  them  within  the  same  temporary  import  permit  for  the  vehicle.

In  the  case  of  motorcycles  or  trimotos  that  enter  the  country  by  their  own  impulse,  that  have  foreign  plates  to  circulate  through  the  general  routes  of  communication,  they  may  be  imported  temporarily  as  long  as  they  comply  with  the  provisions  of  this  rule,  not  being  applicable  for  such  purposes  as  established  in  the  previous  paragraph.

In  all  cases,  it  is  the  obligation  of  the  interested  party  to  present  in  the  CIITEV  Modules  located  in  the  border  customs,  the  temporarily  imported  vehicle,  the  units  registered  in  the  Temporary  Import  Permit,  the  Temporary  Import  Permit  or  in  a  free  writing  in  which  it  is  declared  under  protest  of  telling  the  truth,  the  cause  for  which  the  permit  is  not  presented;  The  foregoing,  in  order  for  the  BANJERCITO  staff  to  record  multiple  entry  or  exit,  or,  if  applicable,  request  proof  of  cancellation  and,  if  appropriate,  the  return  of  the  corresponding  guarantee  deposit;  Otherwise,  the  authorization  of  multiple  entry  or  exit,  the  cancellation  of  the  permit  or  the  return  of  the  guarantee  deposit  will  not  proceed.

The  BANJERCITO  will  return  the  guarantee  deposit  in  the  same  way  that  the  interested  party  constituted  it,  provided  that  the  provisions  of  the  previous  paragraph  are  complied  with.  If  the  guarantee  deposit  was  made  with  an  international  credit  or  debit  card,  the  refund  will  be  made  to  the  corresponding  bank  card,  on  the  bank  business  day  following  the  definitive  return  of  the  vehicle;  or,  if  the  deposit  was  made  in  cash,  the  return  of  the  guarantee  will  be  made  in  cash  at  any  CIITEV  Module  located  at  the  border  customs.

In  high  traffic  seasons,  the  General  Customs  Administration  (Administración  General  de  Aduanas)  may  authorize  the  cancellation  of  the  permit  to  be  carried  out  at  the  authorized  Consulates,  making  known  through  the  Service  Tax  Administration  (Servicio  de  Administración  Tributaria)  Portal,  the  dates  on  which  it  may  be  carried  out.
