RULE  4.5.10:  FISCAL  DEPOSIT  AUCTION

For  the  purposes  of  articles  119  --220-Art.  119--,  119-A  --220-Art.  119A--  of  the  Law  and  177  --53-Art.  177--  of  its  Regulations,  as  well  as  in  accordance  with  articles  10,  21  and  22  of  the  General  Law  of  Organizations  and  Auxiliary  Activities  of  Credit  (Ley  General  de  Organizaciones  y  Actividades  Auxiliares  del  Crédito),  244  and  285  of  the  General  Law  of  Securities  and  Credit  Operations  (Ley  General  de  Títulos  y  Operaciones  de  Crédito),  the  general  warehouses  of  deposit  authorized  to  receive  merchandise  in  the  fiscal  deposit,  that  carry  out  the  auction  of  the  merchandise  of  foreign  origin  in  a  public  auction,  for  having  expired  the  24  month  period  for  the  deposit  provided  for  in  article  119-A,  second  paragraph  --220-Art.  119A--  of  the  Law  or  of  that  agreed  with  the  interested  party  if  it  were  minor,  without  said  merchandise  having  been  removed  from  the  warehouse,  they  will  apply  the  product  of  sale  to  the  payment  of  the  updated  contributions  and,  where  appropriate,  of  the  compensatory  fees,  declared  in  the  customs  declaration  (pedimento)  for  fiscal  deposit,  this  payment  will  be  made  by  submitting  the  customs  declaration  (pedimento)  for  extraction  to  allocate  the  merchandise  to  the  definitive  import  regime.

The  price  paid  for  the  merchandise  may  never  be  less  than  the  amount  of  the  contributions  and,  where  appropriate,  of  the  compensatory  fees,  which  must  be  covered  due  to  the  extraction,  except  when  the  purchaser  assigns  them  for  the  cases  indicated  in  article  120,  sections  III  and  IV  --220-Art.  120--  of  the  Law,  in  which  case  the  product  of  sale  will  be  applied  as  in  accordance  with  the  provisions  of  article  244,  sections  II,  III  and  last  paragraph,  of  the  General  Law  of  Securities  and  Credit  Operations  (Ley  General  de  Títulos  y  Operaciones  de  Crédito).

Whoever  has  destined  the  merchandise  in  question  to  the  fiscal  deposit  regime,  may  not  participate  in  the  auction  either  by  himself  or  through  a  third  party.
