RULE  4.6.7:  PROCEDURE  FOR  INTERNAL  RAIL  TRANSIT

For  the  purposes  of  article  127  --222-Art.  127--  of  the  Law,  in  the  case  of  internal  transits  for  import  and  export  of  merchandise  transported  by  rail  in  containers,  trailers  and  semi-trailers,  the  following  will  apply:

I.  In  the  case  of  internal  import  transit:

a)  The  customs  agent,  customs  agency  or  importer,  will  prepare  the  customs  declaration  (pedimento)  and  print  it,  stating  the  number  of  packages  and  the  commercial  description,  quantity  and  value  of  the  merchandise  as  declared  in  the  bill  of  lading,  or  according  to  the  information  of  the  equivalent  document  that  protects  them  or  of  the  declared  value  for  the  purposes  of  the  insurance  contract  for  the  transport  of  merchandise.

b)  In  the  event  that  the  automated  selection  mechanism  determines  customs  recognition  at  the  customs  at  the  start  of  the  transit,  this  will  consist  of  checking  the  fiscal  stamps  and  the  numbers  of  containers,  trailers,  semi-trailers  or  railcars,  consigned  in  the  customs  declaration  (pedimento),  against  those  physically  held  by  the  means  of  transport,  and  the  information  will  be  sent  to  the  customs  of  arrival  so  that  the  corresponding  recognition  can  be  carried  out  at  the  latter.

In  the  case  of  transits  in  double-stowed  containers,  the  result  of  which  is  customs  recognition,  the  customs  of  initiation  will  send  the  information  to  the  customs  of  arrival  so  that  the  latter  may  be  carried  out.

c)  The  customs  of  commencement  of  transit  may  carry  out  verifications  of  merchandise  in  transport,  only  in  cases  where  the  automated  selection  mechanism  determines  free  clearance  and  risks  have  been  detected  in  matters  of  health,  animal  or  plant  health,  environment,  national  security,  in  all  other  cases,  the  customs  of  departure  will  allow  the  vehicle  to  begin  its  route.

d)  The  rail  transport  concession  company  or  the  controlled  premises  that  receives  the  merchandise  must  present  the  printout  of  the  customs  declaration  (pedimento)  that  protects  the  transit  of  the  merchandise  to  the  customs  of  arrival,  within  24  hours  after  the  merchandise  arrives,  or  in  the  absence,  the  first  business  day  following.

In  the  event  that  the  concessionaire  company  does  not  present  the  printing  of  the  customs  declaration  (pedimento)  in  the  terms  of  the  previous  paragraph,  the  customs  agent,  customs  agency  or  importer  that  initiated  the  transit  may  deliver  to  customs  an  additional  copy  for  the  carrier  or  a  simple  printout  of  the  customs  declaration  (pedimento),  which  has  the  barcode,  even  when  it  does  not  contain  the  certification  of  the  automated  selection  mechanism  nor  the  autograph  signature  of  the  customs  agent,  customs  agency  or  their  mandatary.

In  the  case  of  direct  routes  of  300  kilometers  or  less,  or  when  more  than  one  rail  company  intervenes  in  the  transfer,  the  freight  company  in  charge  of  presenting  the  customs  declarations  (pedimentos)  for  their  conclusion  may  choose  to  send  the  customs  declarations  (pedimentos)  that  protect  the  transit  of  the  merchandise  by  fax.

e)  In  the  event  that  in  the  customs  of  initiation,  the  automated  selection  mechanism  has  determined  free  clearance,  the  customs  of  arrival  will  receive  the  printout  of  the  customs  declarations  (pedimentos)  that  protect  the  transit  of  the  merchandise  and  will  proceed  to  the  conclusion  of  the  same,  if  and  when  the  means  of  transport  has  arrived  at  customs  and  the  physical  presence  of  the  merchandise  is  verified  in  the  fiscal  or  controlled  premises.

f)  In  the  event  that  in  the  customs  of  initiation,  the  automated  selection  mechanism  determines  customs  recognition,  the  customs  of  arrival  will  receive  the  printout  of  the  customs  declarations  (pedimentos)  that  protect  the  transit  of  the  merchandise  and  will  proceed  to  the  conclusion  of  the  same,  having  to  corroborate  the  physical  presence  of  the  container,  trailer  or  semi-trailer,  in  the  fiscal  or  controlled  premises;  check  the  padlocks  and  the  container,  trailer  or  semi-trailer  or  railcar  numbers;  carry  out  the  physical  inspection  of  the  merchandise,  as  well  as  the  documentary  review  of  the  customs  declaration  (pedimento)  and  the  accompanying  documents.

g)  In  the  event  that  the  quantity  or  description  of  the  merchandise  in  the  customs  declaration  (pedimento)  does  not  match  those  that  are  transported,  the  customs  declaration  (pedimento)  will  be  rectified  in  the  terms  of  rule  4.6.13.  --333-Regla  4.6.13--

II.  In  the  case  of  internal  export  transit:

a)  In  the  customs  of  commencement  of  transit,  the  customs  declaration  (pedimento)  for  export  or  return  of  the  merchandise  must  be  formulated,  or  the  consolidated  notice,  in  the  case  of  consolidated  customs  declarations  (pedimentos)  in  accordance  with  articles  37  --201-Art.  37--  and  37-A  --201-Art.  37A--  of  the  Law,  declaring  the  corresponding  code  in  accordance  with  Appendix  2  --379-Apendice  2--  of  Annex  22,  also  the  corresponding  identifier  must  be  declared  according  to  Appendix  8  --388-Apendice  8--  of  said  Annex,  making  the  payment  of  the  corresponding  contributions  and  complying  with  the  non-tariff  regulations  and  restrictions  applicable  to  the  export  regime.

At  the  time  of  filing  the  customs  declaration  (pedimento)  before  the  automated  selection  mechanism,  in  accordance  with  the  provisions  of  rules  2.4.11.  --317-Regla  2.4.11--  and  3.1.33.  --320-Regla  3.1.33--,  as  appropriate,  the  merchandise  must  be  physically  found  in  the  fiscal  or  controlled  premises,  except  in  the  case  of  operations  for  which  the  "Home  delivery"  proceeds.

For  transit,  the  printout  of  the  "Customs  declaration  (pedimento)"  or  the  "Consolidated  Notice  Form"  of  Annex  1  --355-Anexo  1--  must  be  presented,  both  at  the  customs  of  initiation  and  at  the  customs  of  exit,  in  both  cases.

b)  The  transit  of  the  merchandise  will  be  covered  by  the  export  or  return  customs  declaration  (pedimento)  that  contains  the  identifier  of  "Notice  of  internal  export  transit",  which  is  part  of  Appendix  8  --388-Apendice  8--  of  Annex  22  or  with  the  consolidated  notice,  in  the  case  of  consolidated  customs  declarations  (pedimentos)  in  accordance  with  articles  37  --201-Art.  37--  and  37-A  --201-Art.  37A--  of  the  Law.

c)  The  customs  declaration  (pedimento)  or  consolidated  notice,  referred  to  in  the  previous  section,  must  be  submitted  to  the  customs  of  destination  by  the  rail  transport  concession  company,  by  customs  agents,  customs  agency,  exporter,  or  by  the  freight  company  in  charge  of  presenting  the  customs  declarations  (pedimentos)  for  its  closing,  in  the  terms  of  the  provisions  of  the  first  paragraph,  section  I,  subsection  d),  first  paragraph  of  this  rule.

d)  The  customs  of  destination  will  receive  the  consolidated  customs  declarations  (pedimentos)  or  notices,  referred  to  in  subsection  b)  of  this  section  and  will  proceed  to  the  conclusion  of  the  transit,  provided  that  the  means  of  transport  has  arrived  at  customs  and  the  review  is  carried  out  of  the  merchandise  with  the  exchange  list  and,  where  appropriate,  with  the  gamma  ray  images.

For  the  purposes  of  this  rule,  the  rail  companies  must  comply  with  the  following:

I.  Indicate  the  address  to  hear  and  receive  notifications,  as  well  as  the  name  of  the  person  authorized  for  this  purpose,  within  the  circumscription  of  the  starting  customs,  otherwise,  said  notification  will  be  understood  with  the  railway  conductor  himself.

II.  The  rail  transport  concession  company  must  respect  the  order  of  the  railcars  in  the  exchange  list  when  the  pull  enters  the  country.
