ARTICLE 57: TERM FOR ISSUING THE PRELIMINARY RESOLUTION

Within a period of 90 days, counted from the day following the publication of the resolution to initiate the investigation in the Official Journal of the Federation (Diario Oficial de la Federación), the Ministry (LCE: Art. 3) (RLCE: Art. 1) will issue the preliminary resolution (RLCE: Art. 82), by which they can:

Determine provisional compensatory fee, prior to compliance with the formalities of the procedure and provided that they have elapsed at least 45 days after the publication of the resolution to initiate the investigation in the Official Journal of the Federation (Diario Oficial de la Federación);

Not impose provisional compensatory fee and continue with the administrative investigation, or

To terminate the administrative investigation when there is insufficient evidence of price discrimination (RLCE: Art. 38) or subsidy (RLCE: Art. 38A), of the alleged damage or of the causal bond between the two.

The preliminary resolution must be published in the Official Journal of the Federation (Diario Oficial de la Federación) and subsequently notified the interested parties that it is known. (RLCE: Art. 84) (RLCE: Art. 85)
