ARTICLE 188: NOTICE FOR EXTEMPORARY ARRIVAL OF MERCHANDISE IN TRANSIT

     

    In accordance with the provisions of article 40, and in the third paragraphs of articles 128 and 132 of the Law (LA: Art. 40) (LA: Art. 128) (LA: Art. 132), the importer, exporter, customs agent or, where appropriate, the carrier, or the individual or legal entity carrying out the international transit, must notify the Customs Authority of the extemporary arrival of merchandise, sending a copy of it to the customs of destination. This notice must contain the following information (RGCE 2022: Regla 3.7.16):

  • The causes that caused the delay;
  •  

  • The place where the means of transport is located, and
  •  

  • The number of the transit customs declaration (pedimento) and the status of the official padlocks, indicating the causes of the alterations, ruptures or violation thereof, if applicable.
  •  

    The notice must be submitted no later than the day after the incident occurred.
