    They will not be obliged to pay the federal right referred to in this Chapter:

  • Taxpayers whose wastewater discharge for the quarter does not exceed the maximum permissible limits established in the following tables or, where appropriate, in the particular discharge conditions issued by the National Water Commission (Comisión Nacional del Agua) in accordance with the declaration of classification of the body of national waters that corresponds, published in the Official Journal of the Federation (Diario Oficial de la Federación) referred to in article 87 of the National Water Law (Ley de Aguas Nacionales).

    (A), (B) and (C): Type of Receiving Body according to the Federal Rights Law (Ley Federal de Derechos).

     

    For such purposes, the taxpayer must measure the volume at each discharge point in terms of article 277-A of this Law (LFD: Art. 277A) and accompany the statement of the respective quarter the report issued by the laboratory accredited to the entity authorized by the Secretary of Economy (Secretaría de Economía) and approved by the National Water Commission (Comisión Nacional del Agua), which proves that the quality of the discharge is made in terms of the paragraph previous.

    Taxpayers who make discharges that are exempt in the terms of this section and make others for which the right provided in this Chapter must be covered, they must measure the volumes and pay the respective rights under the terms of this Chapter. When exempt volumes are not measured in respect to the rights that must be paid, they will be obliged to pay them for all the volumes discharged, the said exemption being without effect.

  • Those who discharge wastewater to drainage or sewer networks that are not assets of the public domain of the Nation.

  • The populations of up to 10,000 inhabitants, in accordance with the last Census of Population and Housing (Censo General de Población y Vivienda) and the public and private drinking water and sewerage operating bodies, for the discharges coming from them.

    •  

  • For discharges from agricultural irrigation.

    •  

  • Public or private entities that provide non-profit services of medical assistance, social service or provision of free school education for the benefit of rural populations of up to 2,500 inhabitants, according to the latest Census of Population and Housing (Censo General de Población y Vivienda).

    •  

  • Domestic users who are located in locations that lack sewerage systems, due to the wastewater generated in their home.
