    • Annex 304.2: Continuation of Existing Waivers of Customs Duties

    For purposes of Article 304(2) (TLCAN: Art. 304):

  • As between Canada and Mexico, Canada may condition on the fulfillment of a performance requirement the waiver of customs duties under any measure in effect on or before January 1, 1989, on any goods entered or withdrawn from warehouse for consumption before January 1, 1998;

    •  

  • As between Canada and the United States, Article 405 of the Canada-United States Free Trade Agreement is hereby incorporated and made a part of this Annex solely with respect to measures adopted by Canada or the United States prior to the date of entry into force of this Agreement;

    •  

  • Mexico may condition on the fulfillment of a performance requirement the waiver of customs duties under any measure in effect on July 1, 1991, on any goods entered or withdrawn from warehouse for consumption before January 1, 2001; and

    •  

  • Canada may grant waivers of customs duties as set out in Annex 300-A (TLCAN: Anexo 300-A) (Trade and Investment in the Automotive Sector).
