RULE 1.7.4: AUTHORIZATION AND EXTENSION TO MANUFACTURE OR IMPORT OFFICIAL PADLOCKS
For the purposes of article 16-D of the Law (LA: Art. 16D), the legal entities that intend to manufacture or import official padlocks, must submit a request for authorization or, where appropriate, for an extension, in accordance with procedure file 25 / LA (Customs Law) of Annex 1-A (RGCE 2020: Anexo 1A).
In the case of associations, business chambers and their confederations that obtain the authorization related to this rule, they must require users to provide them with the corresponding information through the electronic transmission of data.
Those who obtain the authorization referred to in this rule must comply with the following:
I. Place the folio number of the official padlocks, the identifying code (composed of three letters, as well as the last two digits of the year in which their importation or manufacture was authorized) that the customs authority assigns when granting the authorization corresponding, as well as weekly log the folio numbers of the padlocks.
II. Receive from customs agents, customs agencies, customs representatives, importers or exporters, their accredited legal representatives the payment for the acquisition of the padlocks, which must be made from the bank account that has been registered in the terms of rule 1.6.3. (RGCE 2020: Regla 1.6.3)
III. Deliver the official padlocks by means of a receipt only to customs agents, customs agencies, customs representatives, importers, exporters, or their accredited legal representatives.
IV. Keep a record of the disposals of the official locks that they carry out, which must be presented to the customs authority within the first 5 days of each month, in accordance with the provisions of rule 1.2.2., first paragraph (RGCE 2020: Regla 1.2.2), and contain the following information:
a) The name and patent number of the customs agent, or the name and authorization of the customs agent or customs agency, importer, or exporter, who acquires them.
b) The amount of official locks that are delivered and their folio number.
c) The date of the alienation.
d) Number of the interbank transfer or check and bank account registered in terms of rule 1.6.3. (RGCE 2020: Regla 1.6.3), with which the payment was made.
