RULE 3.7.28: GROUP CLEARANCE
For the purposes of the provisions of articles 3 (LA: Art. 3), 35 (LA: Art. 35), 36 (LA: Art. 36), 37 (LA: Art. 37), 43 (LA: Art. 43), 102 (LA: Art. 102) and 144, section XXXIII (LA: Art. 144) of the Law, companies in the agricultural sector interested in exporting merchandise listed in the "Operation guidelines to process customs clearance" issued by the General Customs Administration (Administración General de Aduanas), which can be consulted on the Service Tax Administration (Servicio de Administración Tributaria) Portal; may carry out group clearance with the competent authorities, at the customs of Tijuana, provided they comply with the following:
I. They are registered with customs, attaching a document in which they request group clearance by the customs authority and other competent authorities and state that they will comply with the provisions of the guidelines indicated in the first paragraph of this rule.
II. They process the customs declaration (pedimento) with the corresponding code according to what is indicated in Appendix 2 (RGCE 2020: Apendice 2), submitting in the identifier block that corresponds to Appendix 8 (RGCE 2020: Apendice 8), both from Annex 22 .
III. That the drivers of the vehicles that transport the merchandise are registered in the "FAST" program of the U.S. Customs and Border Protection.
When the competent authorities detect the breach of any obligation inherent to the facilities granted under this rule and in accordance with the guidelines cited in the first paragraph; or prohibited merchandise are detected or that are objects of illicit contemplated by laws other than tax laws, said facility will be suspended subject to the administrative procedure established in the guidelines referred to in this rule.
