RULE 4.5.7: RECTIFICATION OF THE QUOTA LETTER

    For the purposes of article 119 (LA: Art. 119) of the Law, the data consigned in the "Electronic quota letter" of Annex 1 (RGCE 2020: Anexo 1) will be rectified, by the general warehouse of deposit issuing, the number of times that is necessary, provided that it is done before the activation of the automated selection mechanism referred to in article 43 (LA: Art. 43) of the Law, with the exception of the fields corresponding to the folio of the "Electronic quota letter", the code of the customs or customs clearance section and the patent of the customs agent or the authorization number of the customs agency, importer or exporter that will promote the clearance.

    Once the automated selection mechanism is activated, the rectification of the introduction customs declaration (pedimento) for fiscal deposit will proceed through the customs agent, customs agency or customs representative or accredited legal representative and automatically in the quota letter system, the "Electronic quota letter" of Annex 1 is rectified (RGCE 2020: Anexo 1), issued by the general warehouse of deposit, in the cases in which the rectification of the data of the customs declaration (pedimento) proceeds.

    In the cases in which a general warehouse of deposit receives merchandise that in quantity coincides with that declared in the documents referred to in articles 36 (LA: Art. 36) and 36-A (LA: Art. 36A) of the Law, but there is a discrepancy with the one declared in the customs declaration (pedimento), due to the fact that the amount of the unit of measure of the rate has been erroneously submitted, the rectification of the customs declaration (pedimento) for introduction to fiscal deposit will proceed through the customs agent, customs agency or customs representative or accredited legal representative, having to declare in the customs declaration (pedimento) for rectification the corresponding identifier according to Appendix 8 (RGCE 2020: Apendice 8) of Annex 22, provided that the contributions determined in the original customs declaration (pedimento) are not modified. In these cases, the general warehouse of deposit will send the corresponding arrival report indicating the differences detected.

    The issuing warehouse must give notice of the missing or surplus within 24 hours after the arrival of the merchandise by electronic transmission to the Automated Integral Customs System (Sistema Automatizado Aduanero Integral), for which it must provide the information related to the folio number, electronic acknowledgment, as well as the quantities and tariffs fractions of the missing or surplus merchandise. The Automated Integral Customs System (Sistema Automatizado Aduanero Integral) will provide a new electronic acknowledgment for each notice made.

    The issuing warehouse must notify the General Customs Administration (Administración General de Aduanas) through electronic transmission to the Automated Integral Customs System (Sistema Automatizado Aduanero Integral), when the merchandise due to unforeseen circumstances or force majeure do not arrive within the established deadlines, mentioning in the observations Section the reasons that originated such situation, it must also give notice by the same route, when the merchandise have arrived in accordance with what was declared in the customs declaration (pedimento) and in the "Electronic Quota Letter" of Annex 1 (RGCE 2020: Anexo 1); in both cases the Automated Integral Customs System (Sistema Automatizado Aduanero Integral) will provide an electronic acknowledgment.

    The Automated Integral Customs System (Sistema Automatizado Aduanero Integral) will only allow to give notice of untimely arrival provided there is a prior notice of non-arrival.

    The cancellation of the "Electronic Quota Letter" of Annex 1 (RGCE 2020: Anexo 1) will proceed, until before it is validated with a customs declaration (pedimento). For such purposes, the warehouse that has issued the "Electronic Quota Letter" must electronically transmit to the Automated Integral Customs System (Sistema Automatizado Aduanero Integral), the information regarding the folio and the electronic acknowledgment of the "Electronic Quota Letter", which is intended to be canceled and the cancellation notice. The Automated Integral Customs System (Sistema Automatizado Aduanero Integral) will provide a new electronic acknowledgment for each notice made.
