ARTICLE 62: FACULTY OF THE SECRETARY OF ECONOMY (SECRETARÍA DE ECONOMÍA) TO DETERMINE COMPENSATORY FFES

Corresponds to the Ministry (LCE: Art. 3) (RLCE: Art. 1) that will determine the compensatory fees (RLCE: Art. 89), which will be equivalent, in the case of price discrimination (LCE: Art. 38), to the difference between normal value and export price; and in the case of subsidies, the amount of the benefit.

The compensatory fees may be less than the margin of price discrimination or the amount of the subsidy provided they are sufficient to discourage the importation of merchandise under conditions of unfair international trade practices. (RLCE: Art. 90)
