RULE 3.7.35: CAUSES FOR CANCELLATION OF THE REGISTRATION OF COURIER AND PARCEL COMPANIES

    For the purposes of rule 3.7.3 (RGCE 2020: Regla 3.7.3), the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas) will cancel the registration of courier and parcel companies when they are located in any of the following cases:

    I. Present and / or declare false, altered information or documentation or false data in any procedure related to the registration request referred to in rule 3.7.3. (RGCE 2020: Regla 3.7.3)

    II. They carry out the dispatch of merchandise in contravention to the provisions of articles 59, last paragraph (LA: Art. 59) and 88 (LA: Art. 88) of the Law, in relation to rules 3.7.5. (RGCE 2020: Regla 3.7.5) and 3.7.36. (RGCE 2020: Regla 3.7.36)

    III. Fails to comply with any of the obligations indicated in rule 3.7.4. (RGCE 2020: Regla 3.7.4) or with any of the requirements indicated in the procedure file 78 / LA (Customs Law) of Annex 1-A (RGCE 2020: Anexo 1A), to obtain the registration.

    In the case of the obligations indicated in rule 3.7.4., sections I and II (RGCE 2020: Regla 3.7.4), it will be considered that the present cause for cancellation is updated when the courier and parcel company fails to comply with what is indicated in the last paragraph of the aforementioned rule.

    When possible inconsistencies related to any of the assumptions indicated in this rule are detected, the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas) will require the courier and parcel company to make the corresponding clarification within 10 days from the date the notification takes effect. It will not be considered that the authorities initiate the exercise of their faculties of verification when the requirement referred to in this paragraph is made, so the courier and parcel company may not attend to it.

    For the purposes of canceling the registration, will follow the provisions of article 144-A (LA: Art. 144A) of the Law.

    Courier and parcel companies whose registration has been canceled will not be able to access a new one until a period of 1 year has elapsed from the notification of the resolution.
