RULE 1.8.1: AUTHORIZATION AND EXTENSION TO PROVIDE ELECTRONIC PRE-VALIDATION SERVICES

For the purposes of articles 16-A (LA: Art. 16A) of the Law and 13 (RLA: Art. 13) of the Regulation, those interested in providing the services of electronic pre-validation of data, included in the customs declarations (pedimentos), must request authorization or, where appropriate, the extension, in accordance with procedure file 26 / LA (Customs Law) of Annex 1-A (RGCE 2020: Anexo 1A).

For the purposes of article 144-A, section VI (LA: Art. 144A) of the Law and of this rule, the customs authority may cancel the corresponding authorization, to those who fail to comply with any of the obligations established in rule 1.8.2 (RGCE 2020: Regla 1.8.2).

The people authorized in accordance with this rule may request the voluntary cancellation of their authorization, before the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas), in accordance with rule 1.2.2., first paragraph (RGCE 2020: Regla 1.2.2).

The company whose authorization has been canceled due to non-compliance with any of the obligations established in rule 1.8.2. (RGCE 2020: Regla 1.8.2), as well as their managers, partners or shareholders, may not submit a new request for authorization to provide the electronic data pre-validation services, included in the customs declarations (pedimentos), within a period of 3 years, counted from the date of cancellation. The foregoing will not be applicable when the cancellation has been voluntarily requested.
