RULE 2.3.3: CONTROLLED PREMISES WITHIN THE STRATEGIC CONTROLLED PREMISES AND EXPANSION OF THE SURFACE AREA OF ..THE STRATEGIC CONTROLLED PREMISES

In those cases in which within the property proposed to be enabled as a strategic controlled premises, previously authorized or concession controlled premises are located in terms of the provisions of articles 14 (LA: Art. 14) and 14-A (LA: Art. 14A) of the Law, the person requesting the authorization referred to in article 14-D (LA: Art. 14D) of the Law itself, must submit a request to the Central Administration of Customs Legal Support (Administración Central de Apoyo Jurídico de Aduanas) on the Service Tax Administration (Servicio de Administración Tributaria) Portal, accessing the Digital Window and attach the request made by each of said controlled premises, complying with the requirements established by rule 4.8.1 (RGCE 2020: Regla 4.8.1). These last requests will be processed once the General Customs Administration (Administración General de Aduanas) enables the aforementioned property for the introduction of merchandise under the regime of strategic controlled premises and authorizes its administration. The foregoing will not be applicable in the case of area within or adjacent to a port area subject to the administration of a Comprehensive Port Administration, in the terms of this rule.

In the case of properties located adjacent to the property exclusively enabled for the introduction of merchandise under the regime of strategic controlled premises or area within or adjacent to a port area subject to the administration of an Integral Port Administration, the person who has Authorization for the administration of this property may request the extension of the area originally enabled, in accordance with procedure file 47 / LA (Customs Law) of Annex 1-A (RGCE 2020: Anexo 1A).
