ARTICLE 23: CONCEPT, VALIDITY, REQUIREMENTS AND ASSIGNMENT OF QUOTAS
It is understood as quota for export or import (RLCE: Art. 15) the amount of merchandise that can be exported or imported, either maximum or within a tariff-quota (RLCE: Art. 16). The quota administration may be done through prior permits.
The Ministry (LCE: Art. 3) (RLCE: Art. 1) will specify and publish in the Official Journal of the Federation (Diario Oficial de la Federación) the amount, volume or total value of the quota, the requirements for submitting applications, the validity of the corresponding permit and the procedure for its assignment among interested exporters or importers (RLCE: Art. 26). The determination, modifications and procedures for assigning quotas must be previously submitted to the opinion of the Commission. (LCE: Art. 3) (RLCE: Art. 1)
For the determination of the volume or value of the quotas, the Ministry will take into account the conditions of supply and the national offer of the product subject to quotas, listening to the opinion of the members of the productive chain.
