ARTICLE 39: WHAT IS MEANT BY DAMAGE TO THE NATIONAL INDUSTRY
For the purposes of this Law (RLCE: Art. 1) damage is understood, except for the concept of serious damage for safeguard measures:
In the administrative investigation they must prove (RLCE: Art. 59) (RLCE: Art. 63) that imports in conditions of price discrimination (RLCE: Art. 38) or subsidies, cause damage to the national industry, under the terms of this Law.
The Ministry (LCE: Art. 3) (RLCE: Art. 1) will consider other factors of which it is aware, other than imports in conditions of price discrimination or subsidies, which could affect the national industry. The effect caused by these factors will not be attributed to imports in conditions of price discrimination or subsidies.
