RULE 1.7.5: OBLIGATIONS WHEN USING PADLOCKS IN CUSTOMS OPERATIONS

For the purposes of articles 59-B, section V (LA: Art. 59B), 160, section X (LA: Art. 160), 162, section XI (LA: Art. 162) and 167-F, section VII (LA: Art. 167F) of the Law, customs agents, customs agencies, customs representative, importers or exporters that use padlocks will have the following obligations:

I. Use them only in foreign trade operations that they promote with the patent or authorization they hold. In no case may these padlocks be transferred to another customs agent, customs agency, customs representative, importer, or exporter.

II. Keep a record in which they will write down the following information:

a) The folio number of each padlock they receive and the date of its acquisition.

b) The number of the customs declaration (pedimento) with which they have dispatched the merchandise with which they used the padlock.

III. Place padlocks on vehicles or containers that carry foreign trade merchandise to keep access closed the cargo compartment of the vehicle or container that transports the merchandise, in the manner described in rule 1.7.6. (RGCE 2020: Regla 1.7.6)

IV. Indicate in the corresponding customs declaration (pedimento) the identification numbers (identifying code and folio number) of the padlocks in the "padlock block" according to Annex 22 (RGCE 2020: Anexo 22) and in the case of operations with consolidated customs declaration (pedimento), they must be noted in the consolidated notice without being required to indicate it in the consolidated customs declaration (pedimento).

The provisions of sections III and IV of this rule will not be applicable in the cases indicated in rule 1.7.3. (RGCE 2020: Regla 1.7.3)
